01Acceptance of terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and [LEGAL ENTITY NAME], registered in Spain under company number [REGISTRATION NUMBER], with its registered office at [REGISTERED ADDRESS] and VAT number [VAT NUMBER], operating as "Next Level Academy" ("we", "us", "our").

These Terms govern your access to and use of next-levelacademy.com and the products and services offered through it.

By purchasing a product, registering for a program, or otherwise using our services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use our services.

02Eligibility

You must be at least 18 years old to purchase or use our services. By placing an order, you represent and warrant that:

• You are 18 years of age or older.
• You have the legal capacity to enter into a binding agreement.
• The information you provide is accurate and complete.
• Your purchase is for your own personal use, not for resale or transfer.

03Description of services

Next Level Academy provides the following types of services:

• Self-paced digital courses, including the Next Level course, delivered through our online portal with associated written, audio, and video materials.
• Live group coaching cohorts, including the Next Level Cohort, with weekly group calls led by Mikkel Clausen, ongoing community access, and direct coach availability through the community feed.
• Digital supplementary products, including audio practices, written guides, scripts, and other downloadable materials.

The specific service description shown on our website at the time of your purchase, together with these Terms, defines what you are entitled to receive.

04Pricing and payment

Prices

All prices are displayed in Euros (€) and include applicable VAT where required. We reserve the right to change prices at any time. Price changes do not apply to orders already placed and confirmed.

Payment methods

We accept payment by credit or debit card, processed by Stripe, and by PayPal. By providing your payment information, you authorize us (and our payment processors) to charge the amount you have agreed to.

Payment plans and recurring payments

Where you choose a product with a payment plan or recurring payment structure, you authorize us to charge your chosen payment method automatically on each scheduled date until the plan is complete or you cancel in accordance with these Terms.

If a scheduled payment fails, we will attempt to recharge your payment method. We may suspend your access to the relevant service if payment cannot be collected. You remain responsible for the total amount due under your chosen payment plan, subject to the trial and refund terms below.

Receipts and invoices

A receipt is sent by email after each successful payment. VAT invoices are available on request to [email protected].

05Refund and trial policy

Our refund terms vary by product. Each product's specific terms are confirmed at the point of purchase and summarized below.

Next Level Course (€97)

30-day money-back guarantee. If you are not satisfied with the course within 30 days of purchase, email [email protected] requesting a refund. We will refund the full €97 to your original payment method, typically within 7-14 business days. You may keep any materials you have downloaded.

Next Level Cohort (€2,497 once or €997 × 3 monthly)

14-day trial. You have 14 days from the date of your initial purchase to request a refund. Within those 14 days you receive full access to the cohort, including the first two weekly calls and the community.

• If you request a refund before Day 14, we refund the amount paid (€2,497 for the one-time payment plan, or €997 for the first month if you chose the monthly plan), and no further scheduled payments will be charged.
• Refund requests submitted on or after Day 14 will not be honored. The remaining scheduled payments will be charged as agreed.

Next Level Cohort Payment Plan (€497 first + €997 × 2 monthly)

14-day trial, on the same terms as the Cohort above. If you request a refund within 14 days, the €497 first payment is refunded and the two future €997 charges will not occur. After Day 14, the remaining payments will be charged as scheduled and are non-refundable.

How to request a refund

Email [email protected] within the applicable refund window. Include the email address used for your purchase and your order number. Refunds are processed to your original payment method within 7-14 business days. We will confirm by email once your refund has been processed.

Chargebacks

If you initiate a chargeback or dispute with your bank or card issuer without first contacting us to resolve the issue, we reserve the right to revoke access to all our services and to pursue collection of the disputed amount, together with any associated fees and reasonable legal costs.

06EU right of withdrawal

Under EU consumer protection law, consumers have a 14-day right of withdrawal for distance contracts. However, this right does not apply to digital content where:

• The performance has begun with your express prior consent, and
• You have acknowledged that you thereby lose your right of withdrawal.

When you complete a purchase of digital content from us and immediately access the course materials or community, you give your express consent to the immediate performance of the contract and acknowledge that, by doing so, you lose your statutory right of withdrawal in relation to that digital content.

Our refund and trial policies in Section 5 above provide protections that, in most cases, are more generous than the statutory minimum.

07Intellectual property

Our content

All course videos, written materials, audio recordings, scripts, methodologies (including the "Next Level" methodology and any named protocols within it), brand assets, and other content provided through our services are the intellectual property of Next Level Academy and its licensors. They are protected by copyright, trademark, and other applicable intellectual property laws.

Your license to use

When you purchase a course or program, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the materials solely for your own personal development. This license lasts for the duration of your access to the relevant product (lifetime for products marked as "lifetime access", or for the duration of the program for time-limited products).

Restrictions

You may not:

• Share, distribute, publicly display, or resell our content.
• Record, copy, download, or screenshot videos or live calls for redistribution.
• Use our content to create competing products, services, or training programs.
• Reverse-engineer or extract our methodologies for commercial use by you or any third party.
• Share your account credentials with anyone else or grant access to your account.

Violations may result in immediate termination of your access without refund and may result in legal action.

Your content

Feedback, testimonials, suggestions, ideas, or other non-personal content you provide to us may be used by us for marketing, improvement of our services, or other reasonable business purposes. You retain ownership of such content, and you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display it.

Personal data you provide is governed by our Privacy Policy.

08Community guidelines

If you participate in our cohort community, group calls, or any other community space we host, you agree to:

• Treat all members, coaches, and staff with respect.
• Maintain the confidentiality of personal information shared by others in the community. What's said in the room stays in the room.
• Not record, screenshot, or share community content publicly without express permission.
• Not promote competing products, services, coaches, or programs.
• Not engage in harassment, discrimination, threats, or any conduct that creates a hostile environment.
• Not give medical, psychiatric, legal, or financial advice in the community unless you are a qualified professional and clearly identify yourself as such.

We reserve the right to remove any participant from the community at any time for breach of these guidelines, without refund.

09Disclaimers

Not medical, psychological, or psychiatric advice

Our programs offer personal development coaching grounded in adult education, behavioral practices, and group support. They are not medical, psychiatric, psychological, or therapeutic treatment. Mikkel Clausen and the Next Level Academy team are not licensed therapists, psychologists, psychiatrists, social workers, or medical professionals, and nothing in our programs should be construed as professional medical or mental health advice.

If you are experiencing mental health symptoms, substance abuse issues, suicidal ideation, or any psychological or medical condition, please consult a qualified licensed professional. Our programs are not a substitute for professional treatment, and you should not delay or discontinue any treatment based on your participation in our programs.

Results disclaimer

While we share examples of outcomes that some participants have achieved, individual results vary significantly. We make no guarantees, representations, or warranties about specific outcomes you may experience. Your results depend on your effort, consistency, prior life circumstances, personal context, and many other factors outside our control. Testimonials, case studies, and outcome examples shown on our site represent the experience of specific individuals and are not typical of all participants.

"As is" provision

To the maximum extent permitted by law, our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or completely secure.

10Limitation of liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability to you arising from or related to these Terms or our services shall not exceed the total amount you have paid to us in the 12 months preceding the event giving rise to the claim.
• We will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of revenue, loss of business opportunity, or damages for emotional distress.
• We will not be liable for any damages resulting from your inability to access or use our services, or from any unauthorized access to or alteration of your data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. Your statutory rights as a consumer are not affected.

11Indemnification

You agree to defend, indemnify, and hold harmless Next Level Academy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

• Your breach of these Terms.
• Your violation of any third party's rights, including intellectual property rights.
• Your misuse of our services or content.
• Any unauthorized sharing of community content or member information.

12Termination

We may suspend or terminate your access to our services, with or without notice, if you:

• Materially breach these Terms.
• Violate our community guidelines.
• Engage in fraudulent activity or misrepresentation.
• Initiate a chargeback or payment dispute without first contacting us.
• Fail to pay scheduled installments under a payment plan, after reasonable notice.

You may stop using our services at any time. Termination does not entitle you to a refund except as provided in Section 5. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

13Modifications

We may modify these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Material changes will be notified to you by email or by a prominent notice on our website before they take effect. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using our services. Your statutory rights are not affected.

14Governing law and dispute resolution

These Terms are governed by the laws of Spain, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or our services shall be resolved exclusively in the competent courts of [JURISDICTION], Spain.

If you are a consumer resident in the European Union, the mandatory consumer protection provisions of your country of habitual residence will continue to apply where they offer protection greater than that provided by Spanish law.

As an EU consumer, you have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. You may also submit complaints to the Spanish consumer arbitration system.

15Severability and entire agreement

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced by an enforceable provision that most closely matches the original intent.

Entire agreement. These Terms, together with our Privacy Policy and any product-specific terms presented to you at the point of purchase, constitute the entire agreement between you and us regarding our services. They supersede any prior agreements, communications, or understandings.

No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
